These Terms govern your access to and use of upelia.com, the Upelia mobile application and related services operated by Kess Company LTDA under the Upelia name. By creating an account or using Upelia, you agree to these Terms and to any additional terms shown for a specific course, event, purchase or feature.

1. Purpose of Upelia
   Upelia provides educational courses, videos, exercises, resources, events, community features and information intended to help users develop practical skills. Programs may be free, paid or sponsored. Availability, language, instructors, schedules and included features may vary.

2. Eligibility and accounts
   You must have legal capacity to use Upelia. Minors require authorization and supervision from a parent or legal guardian. Account information must be accurate and kept secure. You are responsible for activity performed through your account and must notify us promptly of suspected unauthorized access.

3. Acceptable use and community conduct
   You must not misuse the platform, interfere with security, attempt unauthorized access, impersonate another person, distribute malware, scrape or overload the service contrary to our instructions, infringe intellectual-property or privacy rights, harass others, or submit unlawful, deceptive, discriminatory or abusive content. We may moderate or restrict content and accounts where reasonably necessary to protect users, the platform or legal compliance.

4. Courses and educational information
   Upelia provides educational information and practical guidance, not a guarantee of income, employment, business results, certification recognition or any particular outcome. Results depend on factors including the learner’s effort, circumstances and application of the material. Content does not replace professional legal, financial, medical or other regulated advice.

5. Purchases, subscriptions and sponsored access
   Prices, billing periods and included benefits will be displayed before purchase. Payments may be processed by Apple, Google, Wix or another authorized provider and may also be subject to that provider’s terms. Refunds, cancellations and renewal rights follow the applicable checkout terms, platform rules and mandatory consumer law. Sponsored access may be limited by eligibility, duration, capacity or sponsor conditions.

6. Program and service changes
   We may update course content, instructors, formats, dates, features or technical requirements. Events or planned offerings may be rescheduled, replaced, suspended or discontinued. Where a material change affects a paid purchase, we will apply the applicable purchase terms and mandatory consumer protections.

7. User content
   You retain ownership of content you submit. By posting content within Upelia, you grant Kess Company LTDA a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and technically adapt that content only as needed to operate, secure and improve the service. You confirm that you have the necessary rights to submit it. You may request deletion subject to legal and operational retention requirements.

8. Intellectual property
   Upelia branding, original course materials, videos, text, graphics, software, layout and other content are owned by or licensed to Kess Company LTDA. Access is personal and non-transferable unless otherwise stated. Content may not be copied, recorded, resold, publicly distributed, republished or commercially exploited without written permission, except where law permits.

9. Third-party services
   Upelia may use or link to services operated by Wix, Apple, Google, payment providers, video hosts, instructors or other partners. Those parties control their own services, terms and privacy practices. We are not responsible for third-party services beyond responsibilities imposed by applicable law.

10. Availability and account restriction
    We work to provide a reliable service, but uninterrupted or error-free availability is not guaranteed. We may temporarily suspend access for maintenance, security or legal reasons. We may restrict or terminate accounts for serious or repeated violations, fraud, security risks or unlawful activity, while respecting applicable consumer rights.

11. Responsibility
    Each party remains responsible as provided by applicable law. Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded, including mandatory consumer rights, fraud or wilful misconduct.

12. Privacy
    Our Privacy Policy explains how personal data is processed through the website and mobile application, including account, learning-progress, transaction and technical data.

13. Governing law
    These Terms are governed by Brazilian law. Disputes will be handled by a competent court or authority, without restricting mandatory consumer rights.

14. Changes and contact
    We may update these Terms and will display the latest revision date. Material changes will be communicated where required.
